Terms and Conditions - Shenron Liveaboard Diving Adventures
Experience a seamless dive adventure with our specialized package, featuring multiple dive days and comfortable overnight stays.
Please note that lunches are provided exclusively on diving days. To support the local community, pick-up and drop-off upon arrival and departure must be arranged in advance, with payment made directly to the driver.
All prices are quoted in Euro / IDR.
For safety, all divers are required to follow our guidelines, including no decompression dives and no solo diving. Any special equipment request will incur additional, non-commissionable costs, payable on arrival.
Additionally, each diving day in Komodo National Park requires a fee of 285,000 IDR per diver, payable in cash (IDR).
We kindly recommend securing comprehensive travel insurance and carefully reviewing our cancellation and rescheduling policies before booking.
Scope of Services
These terms and conditions (“Terms”) apply to all travel packages, diving activities, excursions, accommodations, and ancillary services (collectively, “Services”) offered by DRAGON DIVE KOMODO PMA (“We,” “Us,” or “Our”) to the Tour Operator (“You,” “Your,” or “Client”). By purchasing or promoting Our Services, You agree to be bound by these Terms.
Content of Diving Services
1.1 For our Liveaboard:
- Rooms are based on double occupancy (2 people per room).
- All food is included.
- Prices do not include local taxes, processing fees, or service charges.
- Basic diving equipment included: 3mm wetsuit, BCD, regulator, 12L tank, weights.
- Equipment not included:
o 5mm wetsuit: 100,000 IDR
o Nitrox: 75,000 IDR
o 15L tank: 70,000 IDR
- Full board available for 150,000 IDR/person (excluding alcoholic beverages).
Rental prices are displayed at the Dragon Dive Komodo dive center. Customers are responsible for ensuring they have all necessary equipment before starting their booked activities. Missing optional equipment, such as dive computers, cannot be grounds for cancellation of a dive or related services.
1.2 Training Courses
The price of training courses includes:
- Transportation to the dive site by boat
- Wetsuit, mask, fins, BCD, regulator with octopus, weight belt
- Air and tank for diving
- Diving with an instructor
- PADI certification card (or other applicable certification)
- Dive logbook (online)
For specific courses (e.g., PADI Advanced Open Water or Rescue Diver):
- Dive equipment such as dive computers, SMB, and training materials may not be included unless specified.
1.3 Location of the Activity
All dives, along with practical and theoretical training, are conducted at or out of the Shenron Liveaboard’s address : The Komodo National Park & Alor. We reserves the right to change the location of the activity if necessary.
Rates & Inclusions
2.1 Pricing:
All prices listed are net and non-commissionable and are converted to [IDR]. Prices are subject to change without prior notice due to factors beyond Our control (e.g., fluctuations in exchange rates, surcharges by third-party suppliers, government-imposed taxes, etc.).
2.2 Inclusions & Exclusions:
Each package clearly states what is included (e.g., accommodations, certain meals, diving sessions, specified entrance fees, and transfers) and what is not included (e.g., international flights, travel insurance, personal expenses, visas, optional excursions, dive equipment rental, Park fees, fuel surcharge unless otherwise stated). In the event of ambiguity, please inquire for clarification before confirming bookings.
Diving Eligibility & Requirements
3.1 Certification & Experience:
All divers must hold a valid and recognized diving certification appropriate for the type of diving activities included in the package. Proof of certification will be requested at check-in. Advanced or specialty dives may require higher-level certifications or logged experience.
3.2 Health & Fitness to Dive:
Guests are responsible for ensuring they are medically fit to dive. If in doubt, a current medical certificate from a qualified physician is recommended. We reserve the right to refuse diving activities to any guest deemed unfit to dive for safety reasons.
3.3 Equipment Responsibility:
Unless explicitly stated, dive equipment rental is not included in the package price. Guests who rent equipment are responsible for its proper use, care, and timely return in good condition. Loss, theft, or damage may incur charges.
Availability & Booking
4.1 Reservation Requests:
All bookings must be requested in writing by email [shenron@dragondivekomodo.com] or affiliate booking platforms. Bookings are confirmed only upon Our issuance of a written confirmation and receipt of any required deposit or full payment as per the agreed schedule.
4.2 Minimum/Maximum Participation:
Some Services may be subject to a minimum or maximum number of participants. Should participation fall below the minimum, We reserve the right to adjust prices, services, or cancel the arrangement.
Payment Terms
5.1 Deposit:
A non-refundable deposit of [25%] of the total package cost is required upon booking confirmation, unless otherwise stated.
5.2 Balance Payment:
The remaining balance must be paid in full no later than [15 Days] prior to the start of the Services. If payment is not received by the due date, We reserve the right to cancel the booking and retain the deposit.
5.3 Late Payments:
Late payments may be subject to interest charges and could result in cancellation or re-pricing of Services.
Cancellation & Amendments
6.1 Cancellations by You:
All cancellation requests must be made in writing. Cancellation fees will apply as follows, unless otherwise agreed in writing:
- 25% will be charged if cancelled 60 days or more prior to the embarkation date
- 100% will be charged if cancelled 60 days or less prior to the embarkation date
6.2 Cancellations by Us:
If We cancel a Service before its commencement (except in cases of force majeure), You will receive a full refund of all payments made to Us for that Service. This refund shall constitute full settlement of any and all claims.
6.3 Amendments:
Requests for amendments to confirmed bookings (e.g., date changes, participant substitutions) must be made in writing and are subject to availability, feasibility, and any associated fees or price adjustments. We reserve the right to apply an administrative fee for any changes.
Diving Activity Changes, Weather & Environmental Conditions
7.1 Weather & Safety:
Diving activities are subject to weather, marine conditions, and safety considerations. In the event conditions are deemed unsafe, We reserve the right to alter, reschedule, or cancel scheduled dives at Our sole discretion. Safety is Our top priority.
7.2 Marine Park & Environmental Regulations:
Certain dive sites may require permits or entrance fees (e.g., Komodo National Park). Unless otherwise stated, these fees are not included in the package. Guests must comply with all local rules, environmental guidelines, and regulations aimed at protecting marine life and ecosystems.
7.3 Refunds or Credits:
If dives trips are canceled due to weather or other conditions beyond Our control, We will endeavor to offer alternative arrangements.
Force Majeure
8.1 In the event that performance of Services is compromised by circumstances beyond Our reasonable control, including but not limited to natural disasters, pandemics, strikes, governmental actions, or acts of terrorism, We shall not be held liable for any failure or delay in performance. We will endeavor to offer suitable alternatives .
Liability & Insurance
9.1 Limitation of Liability:
Our maximum liability, whether in contract, tort, or otherwise, shall be limited to the amount actually received by Us for the specific Service that gives rise to the claim. In no event shall We be liable for indirect, special, or consequential damages.
9.2 Assumption of Risk for Diving:
By participating in diving activities, guests acknowledge and accept the inherent risks associated with diving, including but not limited to risks of injury or loss of life. All guests agree to follow safety briefings, instructions, and guidelines provided by Our staff or dive professionals.
9.3 Insurance:
We strongly recommend that all travelers obtain adequate travel, health, and cancellation insurance prior to departure. For diving activities, specialized dive insurance covering diving accidents, medical evacuation, and repatriation is strongly encouraged. You are responsible for ensuring that Your clients are adequately informed and insured.
Use of Third-Party Suppliers
10.1 We may use independent suppliers to provide certain Services. While We take all reasonable care in selecting reputable suppliers, We have no direct control over their operations and shall not be liable for their acts or omissions.
Confidentiality & Intellectual Property
11.1 You agree to treat all pricing, confidential information, marketing materials, and intellectual property shared by Us as proprietary and not to disclose or reproduce such information without Our prior written consent.
Governing Law & Jurisdiction
12.1 These Terms and any disputes arising under or in connection with them shall be governed by and construed in accordance with the laws of Komodo, INDONESIA. The parties agree to submit to the exclusive jurisdiction of the competent courts of Komodo, INDONESIA to the extent permitted by law.
Entire Agreement
13.1 These Terms represent the entire understanding between You and Us with respect to the subject matter herein and supersede all prior negotiations, understandings, and agreements, whether oral or written. Any amendment to these Terms shall be made in writing and signed by both parties.
Acceptance of Terms
14.1 By confirming any booking or accepting any price quotes, You acknowledge having read, understood, and agreed to these Terms and Conditions.
