TERMS & CONDITIONS
Please carefully read our General Booking, Cancellation, Payment, and other Terms which apply to all bookings with Dragon Dive Komodo.
Definition
PMA Dragon Dive Komodo shall be construed to comprise “the Company”, as well as all their affiliates, officers, agents, employees, workers, directors, and representatives.
DIVING:
General booking
All customers must show proof of diving certification from either PADI, SSI, CMAS, or equivalent certifying organizations if taking part in any non-entry level diving activity.
If a customer is unable to provide proof of certification, we will not accept them on board, or they will have to participate in a “paid” intro dive with an instructor.
All customers must complete and sign the relevant Liability Release and Assumption of Risk Form, Continuing Education for all courses made after the Open Water Certification before commencing any scuba diving activities.
The Company is not permitted to dispense any medical advice. If you are unsure of a medical matter related to diving or otherwise, please seek advice from a certified Medical Practitioner before engaging in scuba diving or similar activities.
Upon signing up for any diving course, irrespective of previous experience or training, the Company requires each student to complete a Medical Questionnaire.
The maximum depth permitted on all Company vessels is 30 meters for Open Water Divers with the Deep Adventure Dive certification, Advanced Divers, Rescue Divers, Divemasters, and Instructors. Open Water Divers without any additional Deep training will not be permitted to dive deeper than 18 meters. If a diver has received prior Deep Dive training, then the absolute maximum depth permitted is 40m.
We do not accept any unguided dives during ALL our Liveaboards. For all our trips, a guide must be present with all participants.
The Company reserves the right to modify and/or cancel diving arrangements for reasons including, but not limited to:
- The number of customers scheduled for the trip.
- Weather conditions making the trip to the scheduled destination not possible.
- Other ensuing technical difficulties.
NB: Customers or students who fail to participate in any dives on a trip or any course training dives, for whatever reason, shall not be reimbursed by the Company for any unused or uncompleted portion(s) of the trip or course.
INSURANCE Diving & travel:
Customers are strongly advised to secure appropriate travel insurance, with a reputable insurance provider, applicable to the activities they will be undertaking. Such insurance should provide comprehensive coverage of at least the following: Diving, Medical, Travel, Personal Liability, and Cancellation provisions. The Company shall not be held responsible for any resultant financial or personal loss or injury where customers choose not to secure such insurance.
The Company shall not accept any liability for the loss or damage of any luggage or dive equipment while on board the boat, nor during the transfer(s) to or from the boat.
Komodo National Park requires scuba diving insurance for all LIVEABOARD scuba divers. It’s mandatory to have insurance for all scuba divers for the Komodo National Park, Raja Ampat, Banda Sea & Alor trip.
We are working with DiveAssure, where all our guests can register online and get a 20% discount with our affiliate number.
PAYMENT:
We accept CASH payments in IDR, EURO and USD and Debit/Credit Visa or Mastercard.
NB: A fee of 3% shall be applicable for all payments via credit/debit card (VISA or Master Card) on-site.
We do not accept Paypal, Amex, and JCB cards.
The number of dives in any package is an estimate based on usual diving circumstances and not a guarantee. Where circumstances arise, such as adverse weather conditions, personal illness, technical difficulties, dive site, closure, or any other unforeseen circumstances, the number of dives may be reduced. In such cases, no refunds or compensation will be provided.
BOOKING:
All bookings require a 50% non-refundable deposit to secure the reservation. The remaining balance must be paid in full at least 60 days before the scheduled start date of the trip or course. Failure to pay the balance within the specified time may result in the cancellation of the booking and forfeiture of the deposit.
CANCELLATION AND REFUNDS:
Cancellation by the customer for Hotel Packages and Diving activities excepted Liveaboard:
If a customer wishes to cancel their booking, the following cancellation fees will apply:
– Cancellation more than 30 days before the scheduled start date: Loss of deposit (30% of the total booking value).
– Cancellation between 20 days before the scheduled start date: 50% of the total booking value.
– Cancellation less than 15 days before the scheduled start date: 100% of the total booking value.
Important Update Regarding Cancellation Policy at Dragon Dive Komodo
We would like to inform all our valued guests about an essential update to our cancellation policy. Please note that any cancellations made less than 24 hours before the scheduled activity will not be eligible for a refund. This policy applies regardless of the reason for cancellation.
However, we understand the unpredictability of travel plans and strive to accommodate your needs. In such cases, we are pleased to offer an alternative outing, subject to availability. Please be aware that this rebooking will incur an additional fee of 1,000,000 IDR per participant.
Additionally, we would like to remind guests that the park fees are non-refundable and will be charged separately. We encourage our guests to plan accordingly to make the most of their experience with Dragon Dive Komodo.
For the Liveaboard :
If a customer wishes to cancel their booking, the following cancellation fees will apply:
– Cancellation more than 60 days before the scheduled start date: Loss of deposit (30% of the total booking value).
– Cancellation between 40 days before the scheduled start date: 50% of the total booking value.
– Cancellation less than 30 days before the scheduled start date: 100% of the total booking value.
Cancellation by the Company:
In the event that the Company needs to cancel a trip or course due to unforeseen circumstances, such as extreme weather conditions, technical difficulties, or insufficient bookings, customers will have the option to reschedule or receive a full refund of the amount paid.
LIABILITY:
The Company shall not be held liable for any injury, loss, damage, accident, delay, or inconvenience caused to customers or their belongings during their stay, travel, or participation in any activities organized by the Company, unless due to the negligence or misconduct of the Company.
Customers are responsible for their own personal safety and well-being during their stay and are required to follow all safety instructions provided by the Company’s staff and guides.
FORCE MAJEURE:
The Company shall not be liable or responsible for any failure to perform its obligations or delays caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, strikes, government regulations, or any other event that makes it impossible or impractical to fulfill the booking.
Equipment Rental & Maintenance
- All rented equipment is provided in good working order. Customers should inspect for defects before use and report any issues immediately.
- Customers are responsible for damage, loss, or theft of rented equipment. The Company assumes no liability for injuries or damage caused by equipment misuse or use contrary to standard diving practices.
Personal Health & Fitness Requirements
- All guests must be in suitable physical and mental condition to participate in scuba and related activities. The Company reserves the right to refuse services to individuals who appear medically unfit.
- Guests are encouraged to obtain medical clearance if in doubt.
Child Policy (If Applicable)
- Children under 18 must be accompanied by a parent or legal guardian at all times.
- Any child participating in diving must meet minimum age requirements and present necessary parental consent forms.
Code of Conduct & Environmental Responsibility
- All customers must behave respectfully towards other guests, crew, local communities, and the environment.
- Littering, harassment of wildlife, damaging coral reefs, or any harmful conduct is strictly prohibited.
- The Company may remove individuals from activities without refund if these rules are not followed.
Photography, Media & Privacy
- The Company may take photographs or videos for promotional purposes. Guests who do not wish to appear should inform staff in writing before the trip.
- Personal data will be handled according to applicable privacy laws.
Third-Party Services
- The Company may arrange or recommend third-party services (transport, tours, accommodation). We are not responsible for quality, safety, or standards of these services, nor any injury, loss, or damage arising from their use.
Changes to Terms & Conditions
- The Company reserves the right to amend these Terms & Conditions at any time without prior notice. Updated Terms will be posted on our website, and it is the customer’s responsibility to review them before booking.
Governing Law & Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of the jurisdiction where Dragon Dive Hotel is located. Disputes shall be subject to the exclusive jurisdiction of the local courts.
Acceptance of Terms
By making a booking with Dragon Dive Komodo, customers acknowledge that they have read, understood, and agreed to abide by these Terms & Conditions.
GOVERNING LAW AND JURISDICTION:
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where Dragon Dive Hotel is located. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
Acceptance of Terms
By making a booking with Dragon Dive Komodo, customers acknowledge that they have read, understood, and agreed to abide by these Terms & Conditions.
